Legal Basis and Purpose of the Collection and Use of Personal Data

Personal data are individual details about personal or factual circumstances of a specific or identifiable natural person that are suitable for identifying them. This includes, for example, the civil name, address, telephone number, date of birth, email address, and IP address, but also all other data that can be related to an identifiable person. The legal basis for our handling of personal data is the General Data Protection Regulation (GDPR, from 25.05.2018) and the Federal Data Protection Act (BDSG). We will only collect, process, and store your personal data to the extent necessary for the functional provision of this website and our content and services, as well as for processing inquiries and, if applicable, for handling orders/contracts, but only to the extent that there is a legitimate interest or other legal basis for this.

Data Collection on Our Website

Provision of the Website and Creation of Server Log Files

The hosting provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits.

The following data is collected:

  • IP address of the requesting computer
  • Date and time of access
  • Hostname of the accessing computer
  • Referrer URL
  • Operating system used
  • Browser type and version
  • Name and URL of the retrieved data
  • Transferred data volume
  • Message whether the retrieval was successful

This data is not merged with other data sources.

The storage in log files is done to ensure the functionality of the website. Additionally, the data serves to optimize the website and ensure the security of our information technology systems. These purposes also constitute our legitimate interest in data processing according to Art. 6 para. 1 lit. f GDPR. The data is not evaluated for marketing purposes in this context.

The data will be deleted as soon as it is no longer necessary for achieving the purpose of its collection. In the case of data collection for the provision of the website, this is the case when the respective session is ended. In the case of storing the data in log files, this is the case after no more than 14 days. Further storage is possible. In this case, the IP addresses of the users are deleted or anonymized so that an assignment of the calling client is no longer possible.

The collection of data for the provision of the website and the storage of data in log files is mandatory for the operation of the website. Consequently, there is no possibility for the user to object.

Use of Cookies

Our website uses cookies. Cookies are text files that are stored in the internet browser or by the internet browser on the user's computer system. When a user visits a website, a cookie can be stored on the user's operating system. This cookie contains a characteristic string that allows the browser to be uniquely identified when the website is accessed again.

We use "session cookies" to make our website more user-friendly. Some elements of our internet site require that the calling browser can be identified even after a page change. The following data is stored and transmitted in the cookies:

  • Storage of a login status
  • Filling out multi-page forms
  • Temporary storage of user inputs
  • Display status of control elements
  • Search parameters

Cookies that are necessary for carrying out the electronic communication process or for providing certain functions you desire are stored based on Art. 6 para. 1 lit. f GDPR. We have a legitimate interest in storing cookies for the technically error-free and optimized provision of our services. If other cookies (e.g., cookies for analyzing your surfing behavior) are stored, they are treated separately in this privacy policy.

Cookies are stored on the user's computer and transmitted to our site. Therefore, you as a user also have full control over the use of cookies. By changing the settings in your internet browser, you can disable or restrict the transmission of cookies. Cookies that have already been stored can be deleted at any time. This can also be done automatically. If cookies are deactivated for our website, it may no longer be possible to use all functions of the website to their full extent.

Contact Form and Email Contact

If you send us inquiries via the contact form, your details from the inquiry form, including the contact details you provided there, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not pass on this data without your consent.

The processing of the data entered in the contact form is therefore exclusively based on your consent (Art. 6 para. 1 lit. a GDPR). You can revoke this consent at any time. An informal notification by email to datenschutz@lmx.eu is sufficient for this. The legality of the data processing operations carried out until the revocation remains unaffected by the revocation.

The data you enter in the contact form will remain with us until you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory legal provisions – especially retention periods – remain unaffected.

Alternatively, it is possible to contact us via the provided email address. In this case, the user's personal data transmitted with the email will be stored. There is no transfer of the data to third parties in this context. The data is used exclusively for processing the conversation.

Processing of Data (Customer and Contract Data)

We collect, process, and use personal data only to the extent necessary for the establishment, content, or modification of the legal relationship (inventory data). This is done based on Art. 6 para. 1 lit. b GDPR, which permits the processing of data for the fulfillment of a contract or pre-contractual measures. We collect, process, and use personal data about the use of our internet pages (usage data) only to the extent necessary to enable the user to use the service or to bill for it.

The collected customer data will be deleted after the order has been completed or the business relationship has ended. Legal retention periods remain unaffected.

Data Transfer upon Conclusion of a Contract for Services and Digital Content

We only transfer personal data to third parties if this is necessary within the framework of contract processing, for example, to the credit institution entrusted with payment processing.

Further transmission of the data does not take place or only if you have expressly consented to the transmission. Your data will not be passed on to third parties without your express consent, for example for advertising purposes.

The basis for data processing is Art. 6 para. 1 lit. b GDPR, which permits the processing of data for the fulfillment of a contract or pre-contractual measures.

Social Media

Sharing Content via Plugins (Facebook, Google+1, Twitter & Co.)

The content on our pages can be shared in social networks such as Facebook, Twitter, or Google+ in compliance with data protection regulations. This site uses a tool that establishes direct contact between the networks and users only when the user actively clicks on a button.

No automatic transmission of user data to the operators of these platforms takes place through this tool. Only when you activate the tool by clicking on the corresponding button, a direct connection to the server of the provider is established (consent). Once you activate the tool, the respective provider receives the information that you have visited our site with your IP address. If you are logged into your respective social media account (e.g., Facebook) at the same time, the respective provider can assign the visit to our pages to your user account.

Activating the tool constitutes consent within the meaning of Art. 6 para. 1 lit. a GDPR. You can revoke this consent at any time with effect for the future.

Visitor Statistics

The content management system used provides statistics on the page views of our website. Only the number of views, the time, and the URL are stored for this purpose. No personal data, such as your IP address, is stored.

Analytics Services

We use analytics services to evaluate the surfing behavior of our website visitors. These services are only integrated after consent has been given when visiting the website. Without consent, no connections to the analytics services are established. You can revoke your consent later: Deactivate analytics services.

Plugins and Tools

Google reCAPTCHA

We use "Google reCAPTCHA" (hereinafter "reCAPTCHA") on our websites. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google").

reCAPTCHA is used to check whether the data entered on our websites (e.g., in a contact form) is entered by a human or by an automated program. To do this, reCAPTCHA analyzes the behavior of the website visitor based on various characteristics. This analysis begins automatically as soon as the website visitor enters the website. For the analysis, reCAPTCHA evaluates various information (e.g., IP address, time spent on the website, or mouse movements made by the user). The data collected during the analysis is forwarded to Google.

The reCAPTCHA analyses run entirely in the background. Website visitors are not informed that an analysis is taking place.

The data processing is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in protecting its web offers from abusive automated spying and from SPAM.

For more information about Google reCAPTCHA and Google's privacy policy, please refer to the following links: https://www.google.com/intl/en/policies/privacy/ and https://www.google.com/recaptcha/intro/android.html.

YouTube

Our website uses plugins from the YouTube site operated by Google. The operator of the pages is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA.

When you visit one of our pages equipped with a YouTube plugin, a connection to the YouTube servers is established. The YouTube server is informed which of our pages you have visited.

If you are logged into your YouTube account, you enable YouTube to assign your surfing behavior directly to your personal profile. You can prevent this by logging out of your YouTube account.

The use of YouTube is in the interest of an appealing presentation of our online offers. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.

For more information on the handling of user data, please refer to YouTube's privacy policy at: https://www.google.de/intl/en/policies/privacy.

YouTube with Enhanced Privacy

Our website uses plugins from the YouTube website. The operator of the pages is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA.

We use YouTube in enhanced privacy mode. According to YouTube, this mode means that YouTube does not store information about visitors to this website before they watch the video. However, the transfer of data to YouTube partners is not necessarily excluded by the enhanced privacy mode. Thus, YouTube establishes a connection to the Google DoubleClick network regardless of whether you watch a video.

As soon as you start a YouTube video on our website, a connection to the YouTube servers is established. The YouTube server is informed which of our pages you have visited. If you are logged into your YouTube account, you enable YouTube to assign your surfing behavior directly to your personal profile. You can prevent this by logging out of your YouTube account.

Furthermore, YouTube can store various cookies on your end device after starting a video. With the help of these cookies, YouTube can obtain information about visitors to our website. This information is used, among other things, to collect video statistics, improve user-friendliness, and prevent fraud attempts. The cookies remain on your end device until you delete them.

If necessary, further data processing operations may be triggered after the start of a YouTube video, over which we have no control.

The use of YouTube is in the interest of an appealing presentation of our online offers. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.

For more information about privacy at YouTube, please refer to their privacy policy at: https://www.youtube.com/t/privacy_at_youtube.

Google Maps

This site uses the Google Maps map service via an API. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

To use the functions of Google Maps, it is necessary to store your IP address. This information is usually transferred to a Google server in the USA and stored there. The provider of this site has no influence on this data transmission.

The use of Google Maps is in the interest of an appealing presentation of our online offers and an easy findability of the places indicated by us on the website. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.

For more information on the handling of user data, please refer to Google's privacy policy: https://www.google.de/intl/en/policies/privacy.
